Provisions regarding use of the mobile application 

1. The public institution MENŲ FABRIKAS, code of the institution 302473898, address Kauno st. 30A-1, LT-03202 Vilnius (hereinafter referred to as – the Administrator of the mobile application) is administering the content of the mobile application ONCE IN VILNIUS ( hereinafter referred to as - Mobile application). These provisions should apply to users of the Mobile application if they use the Mobile application and submit their own data into the Mobile application.

2. The Mobile application’s users will be able to submit their own photos or videos not longer than 2 minutes in length about Vilnius (hereinafter referred to as – User’s visual material), placing the User’s visual content into the Mobile application, later from own or other users submitted materials to create short metro films, with the possibility to edit material and participate in the content for the best-submitted User’s visual material. It is planned that at the end of the 2023 year from the Users’ submitted visual materials director team will create a long metro film "Once upon a time in Vilnius". The Mobile application is also intended for review, i. e. the Users may not submit their own material, instead, they can review other Users submitted material.

3. The Mobile application’s user by submitting to the Mobile application the User’s visual material shall guarantee and confirm that this material (a) is created by himself, it is not another person’s material; (b) does not infringe any third persons rights ( private life protection, property, intellectual property, and others rights; (c) the material does not contain any content that is prohibited according to laws of the Republic of Lithuania or contradicts good moral principles. The Administrator of the Mobile application, having received a notification or having established itself any inappropriate content of the User’s visual material, has the right at his own discretion to remove such content from the Mobile application and also block such User’s access to the Mobile application. 

4. The Mobile application’s user by submitting to the Mobile application the User’s visual material shall agree that: 

(a) the User’s visual material without further user’s consent and remuneration can be used in the presentation of the Mobile application to the public; in the presentation of public projects carried out by Vilnius city municipality and its organizations;

(b) the User’s visual material can be adapted/ corrected (this can be done by directors in the creation of the long metro film, also by the User himself and other Users);

(c) in later created films (if the User’s visual content it’s used in the films) to indicate name and surname in the coauthors’ list;

(d) the later created films (if the User’s visual content it’s used in the films) may be further shown, distributed, and otherwise used without further User’s consent and remuneration.

5. In the Mobile application the following personal data of the Users may be collected: name, surname; electronic mail address; data which is included in the User’s provided visual material, and User’s photo (if the User provides it). Also, information about the User’s usage of the Mobile application can be collected, stored, and used, including the User's IP address, geographic location, browser type, login time and length, and the number of pages reviewed.

6. The User’s personal data (except the User’s visual material ) shall be available only to a limited number of employees of the Administrator of the Mobile Application; IT, marketing, legal services providers for the Administrator of the Mobile application, the creators of the full metro film and only at a such scope, as it is necessary to implement the correct management of the User’s personal data, and for all these persons shall be imposed requirements of the protection of confidential information. 

7. Personal data provided in the Mobile application shall be used for the purposes indicated herein. 

8. The User shall be guaranteed any of the below-listed right’s implementation and submission of the related information at the User’s request:

1) to know ( to be informed ) about personal data management;

2) get to know the personal data which is managed and the ways of its management;

3) to request to correct, or delete their personal data or to stop (except storage) actions related to the management of personal data;

4 ) to disagree with a further continuation of management if his personal data, including direct marketing (if such consent will be obtained);

5) to request deletion of the User’s personal data ("right to be forgotten");

6) to request personal data portability, i. e. to allow for the User to get acquainted with his personal data in the form which is usually used and in computer-readable format.

The User himself can remove his submitted visual material. In the cases where the User’s visual material already has been used by other Users in the visual material or in the film; if the User’s visual material already has received assessments ( awards ), - the following materials may be removed on exceptional cases and by decision of the Administrator of the Mobile application.

9. The User’s personal data will be collected in accordance with the legal requirements of the European Union and the Republic of Lithuania. All reasonably appropriate technical and administrative measures to protect the Users’ personal data from loss, not allowed use and changes shall be applied. Any questions of the User regarding the management of personal data or otherwise related to these terms shall be addressed to the Administrator of the mobile application by email: app@kartavilniuje.com

10. These terms are regulated by the laws of the Republic of Lithuania; disputes are solved in Vilnius city courts. The Administrator of the mobile application has the right to change part or all of these terms by submitting information in the Mobile application. Further use of the Mobile application means the User has accepted and followed these changes.
